HIV Positive Houston Man Accused of Sexually Assaulting Indiana Boy

The Harris County District Attorney is painting a bizarre and disturbing picture of a sex crime. The DA says an HIV positive man is suspected of flying a young boy half way across the country for sex.

49-year-old Kevin Lee Sellars was in the Harris County Jail as of Tuesday afternoon, after being arrested late last week.

The DA said Sellars knew he had HIV, but didn't bother to say anything until he had already lured the 15-year-old boy from Indiana all the way to Houston for sex.


"The 15 year old went back to Indiana, the communication continued to some degree, at some point the defendant stated to the individual, 'by the way, I'm HIV positive, have a nice life,"' said Assistant Harris County DA Eric Devlin.

The boy lives with his grandmother in Indiana, but she thought he had been visiting his parents in Channelview. When the boy told her he had actually been exposed to HIV in Houston, she alerted authorities.

The DA said Sellars brought the boy to his Midtown apartment after the two met on the social networking site Myspace. The boy spent 10 days in Houston during December.

"It's not terribly unusual," said Devlin of the distance traveled by the young boy.

The unusual part is Sellars having HIV. Because of this, his bodily fluids amount to use of a deadly weapon during sexual acts. This adds "aggravated" to his "sexual assault of a minor" charge. Devlin said charging someone for using their HIV as a weapon is new to Harris County.

"It's not something I've done before. I've not seen it done before, but it is something that's happened in Texas before," said Devlin.

Neighbors who spoke to 39 News on a condition of anonymity said they've seen several different young boys coming and going from Sellars' apartment. They said the boys were usually quiet and withdrawn, slinking through the apartment's halls focused on their feet.

"When we looked in his brief case we found child pornography," said Devlin of the investigation. "…Approximately a 9-year-old boy engaged in sex."

Furthermore, Devlin said Sellars' computer password is "boylover."

Along with aggravated sexual assault of a minor, Sellars is charged with possession of child pornography. He's being held in the Harris County Jail on $35,000 bond.

Devlin said he will ask to raise that bond in Sellars' next court appearance, which hasn't yet been scheduled.
