Months after a scandal breaks in Carmel, why isn't there an explanation as to whether the former CEO of the Regional Performing Arts Center misused money?

It's been since July when former CEO of the Performing Arts Center in Carmel resigned from his position. Days later, Fox59 learned the city of Carmel paid private investigators $8,000 to follow Steven Libman and his executive assistant, who he was having a relationship with.

At the time, Mayor Jim Brainard was concerned there would be a sexual harassment suit.

The Carmel city council demanded a review, but that was months ago. City Council President Eric Seidensticker is baffled. They asked for the review this past fall.

"Why does it take so long?  A fellow council member says it takes General Motors 90 days to do an audit and yet it keeps getting stalled." Said Eric Seidensticker, president of the Carmel City Council.

But Frank Basille, who is the acting CEO of the center, said the audit isn't done. In fact, Fox59 obtained a letter from the auditor, Blue & Company that said there are existing issues that should be cleared up in a few weeks.

"It's aggravating to me, " said Basille. "I wish it would be done."

So why isn't it?

There are two components to the audit, the financial questions and a separate internal review on whether Steven Libman misused funds. Basille said the sticking issue is what to make of a non-profit that is housed in a building owned by the city.

But what about Libman? Basille won't release the internal revenue until the entire audit is complete.

Some Carmel city council members question whether the center is stalling, in order to prevent Libman from filing a wrongful termination suit under the Indiana statute of limitations.

According to sources, Libman can't find work.

"If I were him, I'd be upset." Said Seidsticker. "To make comments (he is abusing money) is wrong and unfair to an individual."

Libman signed a confidentiality agreement, but insiders said he's fuming and may consider the lawsuit.
