Marion Co. jury indicts former IURC chairman

Marion County Prosecutor Terry Curry announced David Lott Hardy was indicted on three counts of official misconduct, all Class D felonies.

A Marion County grand jury indicted the former chairman of the Indiana Utility Regulatory Commission (IURC) on three felony counts Monday.

Marion County Prosecutor Terry Curry announced David Lott Hardy was indicted on three counts of official misconduct, all Class D felonies.

The first count stated Hardy was “knowingly aiding and abetting Scott Storms by communicating with employees of Duke Energy regarding Storms’ prospective employment while allowing Storms to continue to participate in proceedings involving Duke Energy.”  

Storms was hired by Duke Energy and was an IURC administrative judge.

The other two counts stated Hardy was charged for “failing to disclose an ex parte communication that occurred on March 17, 2008 [and again on February 24, 2010] with an employee of Duke Energy regarding revised cost estimates of the Edwardsport IGCC project.”

“I’m pleased that Grand Jury members returned an indictment and appreciate their hard work on behalf of our community,” said Prosecutor Curry.  “We look forward to vigorously prosecuting this case to its conclusion.”
